At Suzanne Lyttleton Lawyers, we investigate, report and provide elder legal advice on allegations of financial abuse and/or gross mismanagement of an older person’s financial affairs. Litigation is undertaken seeking recovery of assets lost in these circumstances.
In recent times, Suzanne Lyttleton Lawyers has, on Orders from VCAT, conducted investigations into the alleged financial abuse of Represented Persons and presented our findings to the Tribunal.
Aged Care & Elder Law Advice
The number of Australians who are considered to be our older generation (those aged 65 and over) continues to grow and it is projected to more than double by 2057. As the population ages the demand for specialist legal advice in this key area of practice increases.
Elder Law encompasses several different areas of law but at its core is an overriding focus on our responsibilities to those in their later years. More generally, Elder Law plays an important role in ensuring that our aging population is appropriately represented, protected and legally advised.
In advising in the area of Elder Law lawyers must work with the medical, accounting and financial planning professions. However, a practitioner must have as his or her primary purpose the consideration and accommodation (where possible) of the older person’s wishes and also must work to provide older Australians options with regard to their living arrangements, access to services and persons in their later years.
Elder Law addresses the needs and requirements of the ageing population which are unique to that age group. This office is experienced in providing legal services to older Australians and their family members who have concerns relating to the financial and personal vulnerability of elderly members of the wider community.
Persons of advanced years or in frail health can be susceptible to financial, physical and/or psychological abuse by family, friends, carers and other people where there is a dependant relationship or an expectation of trust.
